FatCat App – Terms of Service

Welcome to the FatCat mobile application (“the App”), provided by HWG Holiday Sdn. Bhd. (hence be known as “HWG Holiday”, “we,” “us,” or “our”). By downloading, accessing, or using the App, you (“User,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). Please read these Terms carefully before using the App.

1. Acceptance of Terms

By downloading, accessing, or using the App, you acknowledge and agree to comply with these Terms and our Privacy Policy, which can be found on the app section stated “Privacy Policy”. If you do not agree to these Terms, please refrain from using the App.

2. Description of the App

The FatCat App is designed to provide Users with the ability to book travel packages, hotels, ground arrangements, entertainment packages, obtain concierge service customized packages, and facilitate payment for travel-related services. Users can also input and manage their personal data within the App. We are committed to ensuring the security and privacy of your personal information in accordance with our Privacy Policy.

3. User Registration and Account Security

To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. User Conduct

You agree to use the App in compliance with all applicable laws and regulations. You shall not engage in any conduct that may, in our sole discretion, disrupt or interfere with the operation or security of the App. This includes, but is not limited to, uploading malicious code, attempting to gain unauthorized access to the App’s systems, or engaging in any activity that could harm other Users or our reputation.

5. Booking and Payment

The App allows Users to book travel packages, hotels, ground arrangements, along with other services in relation to travel. Payment for services can be facilitated through the App using secure payment methods. By making a booking and providing payment information, you authorize us to charge the specified amount to the payment method provided.

6. Personal Data and Privacy

We collect and process personal data in accordance with our Privacy Policy. By using the App, you consent to the collection, use, and sharing of your personal data as described in the Privacy Policy.

7. Intellectual Property

The App and its content, including but not limited to text, graphics, images, and software, are the property of HWG Holiday and FatCat, and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial use.

8. Termination

We reserve the right to suspend or terminate your access to the App at our discretion, without notice, for any reason, including but not limited to a breach of these Terms or any applicable law.

9. Disclaimer of Warranties

The App is provided “as is” and “as available” without any warranties of any kind, whether express or implied. We do not warrant that the App will be error-free, secure, or uninterrupted.

10. Limitation of Liability

To the maximum extent permitted by law, HWG Holiday Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.

12. Changes to the Terms

We reserve the right to modify or update these Terms at any time. Any changes will be effective upon posting the revised Terms on the App. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.
